By accessing or using Engivio’s services, including our website, mobile application, and any related services (collectively, the "Service"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, you may not use our Service.

• 1. Engivio is not a healthcare provider and does not provide medical advice, diagnosis, or treatment.
  2. Engivio is a supplemental tool and must be used under the supervision of a licensed physician.
  3. Users must be in generally good health and capable of following recovery recommendations without continuous medical supervision.
  4. Recovery coaches and support staff are not medical professionals and should not be relied upon for clinical decisions.
  5. AI-generated insights are informational only and do not replace medical guidance.
  6. Engivio is not for emergency use. In a medical emergency, call 911 or visit an emergency room.
  7. By using Engivio, you accept these Terms and acknowledge responsibility for your health decisions.

‍1. ELIGIBILITY & USER REQUIREMENTS
‍To use Engivio, you must:
- Be 18 years or older.
- Have a licensed physician overseeing your care.
- Be in generally good health and capable of self-directed recovery.

Engivio must NOT be used by individuals who:
- Are medically frail, require assisted living, or are unable to follow a self-directed recovery plan.
- Have severe pre-existing conditions requiring frequent medical intervention beyond standard post-surgical recovery.
- Are experiencing an acute medical crisis or require urgent intervention.

By using Engivio, you declare that you meet these eligibility criteria and will discontinue use if your medical condition changes.

‍2. NO MEDICAL ADVICE OR CLINICAL SERVICES

‍Engivio does not provide medical advice or treatment. Engivio is a supplemental recovery tool and should not be relied upon as a substitute for professional medical care.

By using Engivio, you acknowledge that:
- You must consult your physician before making any health-related decisions.
- AI-generated insights are for informational purposes only and do not diagnose, treat, cure, or prevent any condition.
- Recovery coaches and customer support representatives are not licensed medical professionals and should not be relied upon for clinical recommendations.
- Engivio must never be used for medical emergencies.

‍3. ARTIFICIAL INTELLIGENCE FUNCTIONALITY & LIMITATIONS
‍Engivio utilizes artificial intelligence (AI) to:
- Analyze patient-reported outcome measures (PROMs) and recovery progress.
- Provide personalized recovery recommendations based on user history and engagement data.
- Detect potential recovery risks and encourage follow-up care.

AI Limitations:
- Engivio’s AI is not a replacement for clinical evaluation.
- AI-generated insights are based on data patterns, not individualized clinical assessments.
- Users must consult their physician before making any changes based on AI-generated recommendations.

‍4. RECOVERY COACHES & CUSTOMER SUPPORT
‍Engivio offers human-led recovery support, but coaches and support representatives are not medical professionals.

User Responsibilities:
- You must not rely on Engivio’s recovery coaches or support staff for medical advice.
- You must consult your physician for clinical recommendations.
- You acknowledge that coaching services are general wellness support, not medical directives.

Engivio is not liable for misuse of coaching services or failure to seek proper medical care.

‍5. DATA COLLECTION, PRIVACY & SECURITY
‍Engivio collects and processes data in compliance with applicable privacy guidelines to enhance user experience and optimize recovery insights.

- Self-reported health data (e.g., pain levels, mobility progress, activity levels).
- Platform usage data (e.g., interactions with AI recommendations, engagement patterns, feature usage).

- To personalize recovery recommendations.
- To optimize platform functionality.
- To conduct de-identified research for analyzing recovery trends.

‍6. USER RESPONSIBILITIES & MEDICAL LIABILITY DISCLAIMER

- You will not hold Engivio liable for any medical outcomes resulting from AI-generated insights or recovery support.

‍Limitation of Liability
‍Engivio is not responsible for any medical complications or injuries arising from use of the platform or incorrect or incomplete AI-generated insights.Failure to seek professional medical care.

Engivio is provided “as-is” and makes no warranties regarding accuracy, effectiveness, or fitness for a particular medical purpose.

‍7. MODIFICATIONS TO THESE TERMS
‍We may update these Terms periodically. If material changes are made, we will notify users via email or in-app notification. Continued use of the Service constitutes acceptance of the revised Terms.

‍8. GOVERNING LAW & DISPUTE RESOLUTION
‍These Terms are governed by the laws of the State of Texas without regard to conflict of law principles.

‍Binding Arbitration: Disputes will be resolved through binding arbitration rather than court litigation.
‍No Class Actions: You may only bring claims against Engivio individually.If arbitration is found unenforceable, disputes will be resolved in courts located in Austin, Texas.
